Welcome to Rachel Mataira (rachelmataira.com). These Terms & Conditions govern your access to and use of our website and the purchase of any products from our online store. By using this site or placing an order, you agree to these terms. Please read them carefully. If you do not agree with any part of these terms, please do not use the site.
1. About Us
This website is operated by Rachel Mataira, a sole trader based in Auckland, New Zealand. References to "we", "us" and "our" mean Rachel Mataira. You can contact us at prints@rachelmataira.com.
2. Orders and Acceptance
Placing an order constitutes an offer by you to purchase the product(s) selected at the listed price plus applicable shipping. We will confirm receipt of your order by email; however, acceptance of your order only occurs when we dispatch the goods. We reserve the right to refuse or cancel any order, including in cases of pricing errors, stock unavailability, or suspected fraud, with a full refund of any payment made.
3. Prices and Payment
All prices are listed in New Zealand Dollars (NZD) and include GST where applicable. Prices and product availability are subject to change without notice. Payment must be made in full at the time of order through one of the accepted payment methods (Shopify Payments, credit/debit card, Afterpay, PayPal, etc.). You must be authorised to use the payment method you choose.
4. Consumer Guarantees Act 1993
Where you purchase goods from us as a consumer (as defined in the Consumer Guarantees Act 1993 ("CGA")), our goods come with guarantees that cannot be excluded under the CGA. These include guarantees that the goods will be of acceptable quality, fit for any particular purpose made known to us, match their description, and be delivered within a reasonable time. Nothing in these terms is intended to limit or exclude your rights under the CGA or the Fair Trading Act 1986. Where you purchase goods for the purposes of a business, you agree that the CGA does not apply pursuant to section 43 of the CGA, to the maximum extent permitted by law.
5. Artwork, Editions and Reproduction
All photographic prints and artworks remain the intellectual property of Rachel Mataira. Purchase of a print or artwork does not transfer copyright. You may not reproduce, copy, scan, resell as a print, or commercially exploit any artwork without prior written permission. Colours may vary slightly between screens and the printed product; this does not constitute a fault.
6. Shipping and Delivery
Please see our Shipping Policy for details on dispatch times, carriers, and international delivery. Risk in the goods passes to you on delivery to the address you nominate.

8. Website Content
All content on this website (images, text, design, logos) is owned by or licensed to Rachel Mataira and is protected by New Zealand and international copyright laws. You may not reproduce, distribute or use the content for commercial purposes without our prior written consent.
9. Disclaimer and Limitation of Liability
To the maximum extent permitted by law (and subject to your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986), our website and products are provided on an "as is" basis. We do not warrant that the site will be error free or uninterrupted. We are not liable for any indirect, consequential or special loss arising from your use of this site or our products.

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 2020.
11. Governing Law
These terms are governed by the laws of New Zealand. Any dispute will be subject to the exclusive jurisdiction of the New Zealand courts.
